PRE-AGREEMENT CONTRACT PROCEDURE INFORMATION
The website at www.tlbmallorca.com is the property of FACTORIA TLB SAU, holder of Spanish Tax ID No. (CIF) A07062466 and with registered tax address at Calle VICENTE ENSEÑAT, 87, 07300, INCA (BALEARIC ISLANDS, SPAIN).
The General Terms and Conditions of Contract regulate the distance selling procedures between FACTORIA TLB SAU and users or customers, pursuant to the legal provisions, in particular Law 7/1998 of 13th April on General Terms and Conditions of contact; Law 3/2014 of 27th March modifying the consolidated text of the General Law for the Protection of Consumers and Users; Royal Decree 1906/1999 of 17th December 1999, regulating Telephone or Electronic Contracts with general terms and conditions; Organic Law 15/1999 of 13th December on the Protection of Personal Data; Law 7/1996 of 15th January on the Regulation of Retail Trading; and Law 34/2002 of 11th July, on Information Society Services and Electronic Commerce.
FACTORIA TLB SAU reserves the right to make any modifications to the General Terms and Conditions it considers appropriate with no prior notice. Said modifications may be made via its websites in any manner accepted by Law and shall remain in effect for as long as they are published on the website and until such a time as they are altered in a valid manner by later modifications. Notwithstanding the above, in certain cases, FACTORIA TLB SAU reserves the right to apply Specific Terms and Conditions of Contract that shall prevail over these General Terms and Conditions as and when it deems necessary, providing due notice in a timely and appropriate manner.
The object of the website is to advertise the sale of footwear, belts and all accessories and complementary products associated with footwear.
Likewise, you may subscribe to the newsletter in order to receive details of offers for the aforementioned products or general information that may be of interest to you.
The contract duration shall be bound to product delivery, without prejudice to the right of withdrawal. As a user or customer, you explicitly declare that you are aware of, understand and accept the terms and conditions of use and the general terms and conditions of contract included herein. Likewise, you declare that you are of legal age and possess sufficient legal capacity and competence to access the FACTORIA TLB SAU websites and to enter into contracts via said websites.

In order to make purchases online, you are required to register as a website user. In order to do so, you may access the corresponding section on the website. Pursuant to Organic Law 15/1999 on the Protection of Personal Data, FACTORIA TLB SAU hereby informs users that the personal data collected during registration and later purchase procedure shall be entered on a file under its responsibility, in order to process said actions carried out by the user and to manage all later actions arising therefrom. Unless you inform us to the contrary, we shall assume that your details have not been modified, that you undertake to inform us of any such modifications and that we have obtained your consent for their use in order to consolidate relations between the parties.
During the purchase process you are required to identify yourself by means of the username and password provided. Said password shall provide access to the services available via the website. Users hold sole responsibility for maintaining the password in the strictest confidence, and therefore assume all damages or consequences arising from the breach or revelation of secret. For security reasons, users may modify the password providing electronic access to the services associated with the Website at any time. Users undertake to immediately inform FACTORIA TLB SAU of the non-authorised use of their password, as well as any unauthorised access thereto by third parties.
You may modify the registered details at any time via the customer area. This section also contains records of your orders; although this section is intended for reference purposes, it may also be modified, and users may therefore delete those registers they consider they no longer need to view.
Once the purchase process is complete, customers will receive confirmation thereof via email. During the purchase process, users are required to provide a valid email address. On receipt of the products at the address provided, customers will receive an invoice or copy of their order.
OFFER AND VALIDITY
In the case of products on offer, details of their key characteristics will always be provided, together with the offer price and validity thereof.
In accordance with the regulations in effect, FACTORIA TLB SAU provides details of all items on sale, their characteristics and prices. Notwithstanding the above, FACTORIA TLB SAU reserves the right to withdraw, restock or change the products offered via its website simply by altering the contents thereof. In this sense, the products offered on the website shall at all times be subject to the General Terms and Conditions of Contract in effect in each case. Likewise, the company shall be entitled to cease to offer the aforementioned products at any time and with no prior notice.
KEY PRODUCT CHARACTERISTICS
The descriptions of the products offered for sale at our online store include photographs and the key characteristics thereof, comprising information obtained from the manufacturer. The product colour shown in the photograph is not binding. The colour is specified in the product features.
GUARANTEES
All products offered on the website include the supplier’s commercial guarantee. FACTORIA TLB SAU offers an after-sales service; whilst the guarantee remains in effect, customers may execute it by sending an email to the FACTORIA TLB SAU after-sales service at eshop@tlbmallorca.com
PRICES
The retail price of each product is given in euros and is inclusive of Value Added Tax (VAT).
Any other applicable taxes shall be duly indicated.
SHIPPING AND DELIVERY COSTS
FACTORIA TLB SAU ships items to the countries listed under the ‘DISPATCH’ section of the website. The shipping charges specified in each case shall be applied.
PAYMENT METHODS
Customers may pay for their order by any of the following means. They must specify their payment choice during the purchase process:
VISA / MASTERCARD credit card and VISA debit card
All operations that require the transfer of personal or bank details are made in a secure server environment based on standard SSL (Secure Sockets Layer) technology. All the information you send to us over the network is encoded.
Furthermore, your credit card details are entered directly on the bank’s PST (Point of Sale Terminal) on its website and are not entered or registered on any FACTORIA TLB SAU servers.
When paying by VISA or MASTERCARD you will always be asked to provide the following details:
The card number, expiry date and a Validation Code that matches the last three figures on the number printed in italics on the back of your VISA or MASTERCARD card, thereby provided additional guarantees in terms of transaction security.
This payment method is valid on the website only.
When the cost of a purchase has been charged in a fraudulent or wrongful manner using a payment card number, the holder thereof may demand the immediate cancellation of said charge. In this case, the corresponding charge and reimbursement annotations to the supplier’s and cardholder’s accounts shall be made at the earliest possible opportunity.
However, should the purchase have been made by the cardholder and the reimbursement request is not due to the exercise of the right to withdrawal or cancellation, and therefore the request for the cancellation of the charge has been unduly made, the cardholder shall be liable to compensate FACTORIA TLB SAU for the damages caused as a result of said cancellation.
PayPal
This is a safe and convenient online payment method. The PayPal network is based on the existing financial infrastructure comprising bank accounts and credit cards in order to provide a global payment solution in real time. PayPal offers a service designed especially for those who are not satisfied with traditional payment methods.

DELIVERY PERIODS
Your order will leave our factory in a maximum period of 10 working days from the date you place your order.
Should orders be delayed for reasons not attributable to FACTORIA TLB SAU, the days corresponding to said delays shall not be included in the periods specified above.
Each delivery shall be considered to have been made when the carrier places the product at the customer’s disposal.
In the case of delays in the delivery of orders attributable to FACTORIA TLB SAU, the customer may cancel the order in accordance with the section on the Right of Withdrawal.
RIGHT OF WITHDRAWAL, RETURNS AND COMPLAINTS
Buyers have a maximum of 2 calendar days in which to withdraw, starting on the day they receive confirmation of their order, with no sanction whatsoever and no need to state the reasons for said withdrawal.
Buyers wishing to exercise their right of withdrawal must do so by writing to the following email address: eshop@tlbmallorca.com . Pursuant to article 103 of Law 3/2014 of 27th March modifying the consolidated text of the General Law for the Protection of Consumers and Users, the supply of services or goods made in accordance with the consumers’ specifications or that have been clearly personalised and made to order (MTO), or which, due to their nature, may not be returned or may become damaged or expire quickly, are exempt from withdrawal. In this sense, CUSTOMERS acknowledge and accept that due to the specific nature of said products, they are not entitled to said right of withdrawal, return or exchange. Please note that shoes that include a metal toe cap cannot be exchanged or returned.
Returns
FACTORIA TLB SAU reserves the right to accept or refuse any return. Please read the return instructions carefully.
FACTORIA TLB SAU shall not accept any returns that have not been previously authorised. No returns with unpaid postage will be accepted.
Customers must return or hand in the products directly to FACTORIA TLB SAU at the following address: Calle VICENTE ENSEÑAT, 87 07300, INCA (BALEARIC ISLANDS, SPAIN), with no undue delay and in all cases, within 10 calendar days following the date when the right of withdrawal from the contract is formalised. Said period shall be understood to have expired if the customer returns the product before this period has elapsed.
Customers are responsible for returning the product by their own means. Likewise, they shall be responsible for all costs arising from the product return, including carriage, customs and excise duties and all bank charges relating to the purchase.
In all cases, the returned items must be in perfect condition, unused and in their original packaging. In order to prevent problems during shipping, you are therefore asked to ensure that the package is properly protected and sealed. Once the item(s) have been received, we will check their condition. Once we have confirmed that the item(s) and any component parts, accessories, promotional gifts and documents are complete and in perfect condition, we will proceed with the refund for the amount paid.
The following items may not be returned under any circumstances:
- Any customized product or that has been modified by the customer.
Reimbursement
Reimbursement of the amounts received by customers shall be made using the same payment method employed by customers, provided that no arrangement to the contrary has been made. FACTORIA TLB SAU may withhold reimbursement until the product subject to withdrawal has been received, or until the customer provides proof of return thereof, depending on which requirement is met first.
Return of faulty products
If the product is not in good condition for reasons not attributable to the customers, they are entitled to return the product, informing FACTORIA TLB SAU of the reasons for said return by any of the channels stipulated in these terms and conditions of contract, and at no cost to customers. Returns of items that are faulty or in poor condition shall not be considered a right of withdrawal.
FACTORIA TLB SAU shall pay the costs of the return and shall replace the product with a new one, in accordance with the terms and conditions accepted at the time of sale.

JURISDICTION
Likewise, FACTORIA TLB SAU reserves the right to take any civil or criminal action it deems appropriate as a result of the wrongful use of its website and contents or the breach of these terms and conditions.
The relationship between users and the provider shall be regulated by legislation in effect and applicable in Spain. In the event of any controversy between the parties, they may submit said conflicts to arbitration or ordinary jurisdiction in compliance with the corresponding legal regulations and competences in this sense.
